MARITIME CONSULT is a partner company of Offshore Boote GmbH from Vienna, which developed during the last 20 years under the leadership of the Austrian veteran of the motor yacht sport, Gerhard Bergmann, into the largest motor yacht charter company in Croatia.

During these years, we have acquired profound knowledge, a lot of experience, estimated, bought and sold countless yachts, and we know the yacht market and its problems better than any other. Of course, we learn continually through practice, training and technical literature.

We are a staple in the yacht business - especially in Croatia. With our offices in the Marina Kremik / Primošten and Rogoznica and more than 20 staff members who speak German-among other languages, we are able to handle jobs locally without having to charge high travel costs. Due to our huge manpower, we are able to handle large projects professionally and effectively. Over the years we have created an excellent infrastructure on the spot which makes a lot of things easy.

Our in-house legal department ensures that we are always up to date concerning the regulatory stipulations and able to make competent and professional statements regarding the tax and customs issues in Croatia, to handle complex correspondence and if necessary, to establish companies.

Even with yachts, the desired price is a very different cup of tea from the purchase price. Thus, a purchase appraisal is a very useful basis for decision, for both seller and buyer.

If you, as a seller, want to know what you can achieve as a realistic selling price for your boat, it is recommended, especially now in the supersaturated second-hand boat market, to have your boat appraised. You will get a concrete idea of what is feasible and, above all, a purchase appraisal is an excellent tool in terms of sales, because in addition to the realistic market value, it shows the actual condition of the ship, which certainly creates a lot of confidence in potential buyers.

If you want to buy a yacht and you basically found a suitable yacht and informed already extensively about the yacht type, it is always advisable to have your dream yacht inspected yet again by a third party. The very objective view of an independent person may help to avoid financial losses. The desire for a new yacht can easily cloud the objective view. Small defects, which are represented by the seller as not important may later turn out to be very costly. Thus such a purchase appraisal is an excellent decision-making basis for a potential yacht buyer.

In purchase appraisals we determine all relevant issues of yachts and boats on the basis of a review. The type and the duration of use, as well as state, functions, and security and any necessary maintenance or maintenance costs are taken into account.

A valuation report includes a detailed and comprehensive inspection of the boat in terms of its condition. In contrast to the purchase appraisal, a valuation report includes in addition to the evaluation of all components related to general defects and damage, a cost-based calculation of costs and extent of necessary repairs based on a list of deficiencies. Also, standard depreciation values play a great role for a realistic assessment of a yacht and are also taken into account.

Furthermore, a market analysis of comparable boats is carried out based on the vessel data. On the basis of these two values, an estimated market value is determined.

An increasing number of insurance companies or leasing companies define their bonuses and lease payments on the basis of a valuation report and this may also be a basis for the policyholder to reduce the insurance value, which may lead to big savings with large yachts.

Currently, the taxation problem in Croatia before the forthcoming EU accession in July 2013 is a relevant topic, thus independent and objective appraisal will play a major role.

For the preparation of a damage report, we investigate with a thorough understanding of the repairs cost the replacement value and the possible resulting loss of value.

Special requirements, extensive damage or problems during the settlement of damages may make a damage report advisable or even necessary.

Not all damage is obvious or can be discovered by an amateur. If damage is overlooked in the acute case, it can result in huge losses or at least in an unexpected depreciation.

An appraiser determines the damage for you and supports your belongings until repairs are completed, which can save you from heavy losses. The work is documented photographically and in writing and may be helpful in court.

   
   
 

Customs Clearance in Croatia

 
 

 

 

All owners whose vessels were in a customs warehouse at the time of joining the EU, on 1.7.2013, i.e. in a Croatian marina, have to take some action and make a customs declaration. No matter what size, what age and whether at the end of the day a payment is due or not.

As for the vessels which were not in a marina at the time of EU accession, there is no concrete statement to date.

Boats which are older than eight years, with a length of up to 12 meters, are customable at 1.7%, yachts over 12 meters in length will be customs exempt only in case of a seaworthiness category A or B. Even if no customs duty is due, a customs declaration must be made.

For untaxed yachts which are younger than 8 years, the full VAT tax is due.

The measure of customs clearance must be completed within 18 months after the last registered customs entry. This should have been performed during the well-known 18-month regulation, which existed in Croatia before the EU accession. Therefore it is quite urgent if this was a while ago.

For the customs declaration, proof of performed registration before 1.7.2005 is required and numerous other documents must be submitted. Here the greatest care must be taken because the authorities can insist on full taxation - 25 % - if unacceptable evidence is submitted.

As far as the establishment of the fair value of yachts is concerned, for yachts which are found in the Schwacke List, this list shall be used. For somewhat older yachts, which are not found in this list, the customs authority shall set a value based on research.

Basically, we can assume that the amount of work with older boats will probably be more extensive, because here we have to research intensively, in order to determine the realistic fair value as the basis for the customs clearance.

The whole process involves many preparations and visits to authorities; although this can basically be done by the owners themselves, the process is very nerve racking and time consuming, due to the language barrier and the complexity of tasks.

We can take all necessary measures for an efficient and inexpensive customs declaration and thus ensure a hassle free start of the upcoming water sport season in Croatia.

Since many boat owners wait with the declaration literally until the last moment, please be warned here: with an estimated 10,000 ships that fall under this regulation, a significant application amount is to be expected, which will certainly overload the competent Croatian customs authorities. We therefore advise all owners to submit the documents as soon as possible to avoid a processing jam, which ultimately falls back on the owners.

First, simple procedures have been completed by us, for special cases, the statutory rules are to be awaited. Here the greatest care is called for, because in case of a rejection, the owners are still in danger of having to pay the additional Croatian VAT of 25%.
